Taxation changes for patents – maybe?

A plan originally proposed under the former Labour government to introduce more favourable treatment of taxation on royalty income derived from patents is still expected to go ahead this autumn. It’s generally accepted that a healthy economy relies on innovation across the board, and the previous government believed that a tax system that treated research and innovation more sympathetically would encourage investors to see the UK as a good place to do business, creating jobs and contributing to economic growth.

If implemented as planned, the new taxation regime is likely to be relevant only to patents granted after a new Finance Act enters into force, probably summer 2011, and will be applied to royalty income derived from those patents from April 2013. Owners of patent applications likely to be granted before April 2011 may choose to consider delaying their applications in order to benefit from this potential legislation.
